Requirements for Sex Offenders

A sex offender must acknowledge that his/her responsibility to register as a sex offender is a lifetime requirement.

Upon coming into, or when changing address or transient location within, any city, county, or city and county in which the sex offender is residing or located, he or she must register with the law enforcement agency having jurisdiction over his/her residence or location within 5 days.

When changing my residence address, or transient location either within California or out of state, I must inform the registering agency with which I last registered of the new address or transient location within 5 working days.

It is a sex offender’s duty to know the legal requirements of Penal Code section 290, including changes to the law.  These requirements include, but are not limited to, the following:

Upon release from incarceration, placement, or commitment, within 5 working days, he/she must register or re-register if he/she has previously registered, with the law enforcement agency or agencies having jurisdiction over his/her location or places of residence.

A sex offender must annually, within 5 working days of his/her birthday, go to the law enforcement agency having jurisdiction over their location or place of residence and update their registration information, including employer’s name and address.

Within 5 working days of changing his/her name, a sex offender must notify the law enforcement agency having jurisdiction over his/her transient location or place of residence.

If a sex offender moves out of California, he/she is required to register in any state in which he/she is located or residing, within 10 days, with the law enforcement agency having jurisdiction over their residence or transient location.

If a sex offender attends school or is employed in another state, he/she must notify the law enforcement agency in the state having jurisdiction over the school or employment location in addition to registering in his/her state of residence.

If a sex offender has no residence address (transient), in addition to the requirement to register annually within 5 working days of his/her birthday, he/she must update his/her registration information at least once every 30 days and register a change of transient location within 5 working days with the law enforcement agency having jurisdiction over his/her location.

If a sex offender has ever been designated a sexually violent predator, he/she must update his/her registration information at least once every 90 days and annually within 5 working days of his/her birthday.

If a sex offender has ever been convicted of a felony sex offense and he/she has not previously given DNA samples, he/she is required to submit two specimens of blood, a saliva sample, a thumbprint and full palm print of each hand (PC 296).

A sex offender must provide proof of residence with a California Driver’s License or Identification Card or a recent rent or utility bill within 30 days of registration.

If a sex offender is a parolee he/she must provide proof of registration to my parole agent within 6 working days of release on parole.

If a sex offender is enrolled, employed (with or without compensation), or is located or resides on a university, college, community college or any other institute or higher learning, he/she must register with the campus police or law enforcement agency having responsibility over that campus in addition to registering with the local law enforcement agency having jurisdiction over his/her residence or transient location, and notify the registering agency for the campus within 5 working days of ceasing to be enrolled or employed with the campus.

If a sex offender has more than one residence address or transient location, he/she must register all addresses and/or locations with the agency or agencies having jurisdiction over them.
