SECTION 1: PURPOSE
The
purpose of this policy is to provide guidance in understanding the hours of
work of positions in the classified service, and to provide guidelines in the
determination of work hours, rest and meal periods.
The
provisions of this policy are subject to the terms and conditions of
appropriate memorandum of understanding.
SECTION 2: BUSINESS
HOURS
The
City of Lodi conducts business during normal business hours which are from 8:00
a.m. to 5:00 p.m., Monday through Friday.
Departments and their divisions may vary from these hours and days
relative to the services they provide to the citizens of Lodi.
SECTION 3: WORK
PERIOD
The
work period is an established and regularly recurring period of work which,
under the terms of the FLSA, cannot be less than 7 consecutive days nor more
than 28 consecutive days. Except for
this limitation, the work period can be of any length, and it need not coincide
with the duty cycle or pay period or with a particular day of the week or hour
of the day. Once the beginning and
ending time of an employee's work period is established, however, it remains
fixed regardless of how many hours are worked within the period. The beginning and ending of the work period
may be changed, provided that this change is intended to be permanent and is
not designed to evade overtime compensation.
Work
Day: A work day shall be the time
worked within a designated 24-hour period (12:00 a.m. to 12:00 a.m.) such that
an employee performs his/her duties in accordance with the duty cycle
established by his/her department.
SECTION 4: BREAKS
AND MEAL PERIODS
Federal
and State laws do not require public employers to provide breaks and meal
periods. Subject to the provisions of
the appropriate memorandum of understanding, break and meal period duration and
scheduling are determined at the discretion of the Department Head. Such determination shall include, but not be
limited to, considerations such as workload distribution among employees,
workload priorities, and departmental priorities.
Breaks are considered as
paid time by the City. If approved,
breaks shall not exceed 15 minutes in duration.
Subject
to the provisions of the appropriate memorandum of understanding, meal periods
shall not be considered paid time, and shall not exceed sixty (60) minutes in
duration during an employee's workday.
